The website materikadigital.com and the Materika Digital marketplace are operated by Cristian Pesenti (trade names Frank Ricci Design / Materika Digital), an individual holding an Italian VAT number. Seller details below.
Sale of digital content (graphic files for wrap design) via download. The purchase grants a Licence of Use; it does not transfer intellectual property.
Prices in Euro (€). Transaction with no VAT applied, flat-rate scheme (art. 1, paras. 54-89, Italian Law 190/2014). Payment via Stripe (card) and/or credits (1 credit = €1). Card details are handled by Stripe as the payment processor; Materika does not store them.
Digital and immediate: once payment is confirmed you receive access to the download (post-payment link / account area). No physical shipping. In case of a download problem, write to info@frankriccidesign.com within 14 days.
For digital content supplied via download, the consumer loses the right of withdrawal if the download begins with their express consent and acknowledgement of the loss of withdrawal (Italian Consumer Code art. 59(o)). Mandatory checkbox at checkout, before payment:
“I request the download to begin immediately and acknowledge that, by starting the download, I lose my 14-day right of withdrawal under art. 59(o) of the Italian Consumer Code.”
As long as the download has not started, the 14-day right of withdrawal remains valid. For professional/business buyers (B2B), the consumer right of withdrawal does not apply.
If a file is corrupted or does not match its description: re-download or replacement within 14 days. No refund for a change of mind after the download (see §5).
Credits are a prepaid wallet purchased in a single payment (one-off, no subscription and no recurring charge). 1 credit = €1, purchased at full value. When you spend credits across the catalog you get a 30% discount off the list price (not combinable with products already on offer). Credits accumulate and never expire. They are not convertible into cash nor refundable and are not transferable to other accounts. An account is required.
No refund for: credits already spent, content already downloaded. Faulty or non-conforming files: re-download or replacement within 14 days (see §06).
All graphics remain the property of Cristian Pesenti. The purchase grants only the Licence of Use; reselling or redistributing the files = copyright infringement.
Processing is described in the site’s Privacy Policy. GDPR compliant. Stripe is an external processor for payments.
Italian law. With consumers, the mandatory jurisdiction is the consumer’s place of residence. For B2B relationships, the competent court is the Court of Brescia.
Materika may update these Terms; the version published on the date of purchase applies. Date of last revision at the bottom.
